The Mortgage Foreclosure Task Force (MFTF) was created by Act 162, SLH 2010 (the “Act”) to “conduct an extensive analysis of all factors affecting mortgage foreclosures in the state and to recommend appropriate legislation.”
In addition to the tasks set forth in the Act, the conference committee report for SB 651 SD2 HD2 CD1, a.k.a. Act 48, SLH 2011, specifically requested that the MFTF address “The special situation of association lien foreclosures and the interests of all association members in timely collection of assessments for common expenses…”:
On June 28, 2012, Governor Abercrombie signed Act 182, Session Laws of Hawaii 2012 relating to foreclosures, which adopts most of the recommendations contained in the MFTF’s 2011 report, into law.
The Act specifies that the MFTF shall be composed of representatives of stakeholder groups drawn from the following organizations and agencies:
- The DCCA Office of Consumer Protection;
- A United States Department of Housing and Urban Development (HUD) approved mortgage counseling organization;
- The Legal Aid Society of Hawaii;
- The Hawaii Financial Services Association;
- The Hawaii Bankers Association;
- The Hawaii Credit Union League;
- The Hawaii Council of Associations of Apartment Owners;
- The Hawaii State Bar Association Collection Law Section;
- The Hawaii State Bar Association Bankruptcy Law Section or the Bankruptcy Court of the United States District of Hawaii; and
- The Hawaii State Judiciary
In addition, the Chair of the MFTF may appoint additional members in order to “…maintain a balanced representation of interests…”.
