DCCA DISCIPLINARY ACTIONS

(Through December 2017)

HONOLULU – The state Department of Commerce and Consumer Affairs (DCCA) and the state Boards and Commissions released a summary of disciplinary actions through the month of December 2017 taken on individuals and entities with professional and vocational licenses in Hawaii.  These disciplinary actions include dispositions based upon either the results of contested case hearings or settlement agreements submitted by the parties.  Respondents enter into settlement agreements as a compromise of claims and to conserve on the expenses of proceeding with an administrative hearing.

The DCCA and the Boards and Commissions are responsible for ensuring those with professional and vocational licenses are performing up to the standards prescribed by state law.

 

BOARD OF ELECTRICIANS AND PLUMBERS

Respondent:        Nakoa I. Pabre (Hawaii)

Case Number:     ENP 2017-10-L

Sanction:             $1,000 fine                                                                                                                       

Effective Date:     12-12-17

On November 6, 1996 and October 30, 1997, Respondent was allegedly convicted of Contempt of Court. On November 20, 2008, Respondent was allegedly convicted of Assault in the Third Degree.  Despite the convictions, Respondent answered “no” to question 4 on his Application for Exam and License dated March 2, 2009, which asked, “In the past twenty years, have you ever been convicted of a crime in which the conviction has not been annulled or expunged?”, in possible violation of HRS §§ 436B-19(5) and 448E-10(a)(1).  Also, On October 9, 2014, Respondent was allegedly convicted of Failure to Appear. Despite the conviction, Respondent answered “no” to question 3 on his Renewal/Restoration Application dated November 5, 2015, which asked, “In the past three years, have you been convicted of a crime in which the conviction has not been annulled or expunged?”, in possible violation of HRS §§ 436B-19(5) and 448E-10(a)(1).  (Board approved Settlement Agreement.)

 

Respondent:        Samuel K. Alameda (Hawaii)

Case Number:     ENP 2016-45-L

Sanction:             $500 fine                                                                                                                          

Effective Date:     12-12-17

On or about May 18, 1993, Respondent was allegedly convicted of Commercial Promotion of Marijuana in the Second Degree. On or about January 14, 1998 and April 25, 2003, Respondent was allegedly convicted of Criminal Contempt of Court.  On or about November 1, 2002, Respondent was allegedly convicted of Failure to Appear. Despite the convictions, on or about June 3, 2006, Respondent submitted an application for a journeyman electrician’s license wherein he answered “no” to question no. 5 which asked, “In the past twenty years, have you ever been convicted of a crime in which the conviction has not been annulled or expunged?”, in possible violation of HRS §§ 436B-19(5) and 448E-10(a)(1).  (Board approved Settlement Agreement.)

 

BOARD OF PROFESSIONAL ENGINEERS, ARCHITECTS, SURVEYORS, AND LANDSCAPE ARCHITECTS

Respondent:        William J. Zastrow, P.E.

Case Number:     ENG 2015-9-L

Sanction:             Voluntary suspension of license for one year and $1,000 fine                                       

Effective Date:     12-14-17

Respondent allegedly improperly plan stamped two (2) sets of drawings submitted as part of an application for building permits, in possible violation of HAR §§ 16-115-8(a)(1);(2);(3) and 16-115-10(5).  (Board approved Settlement Agreement.)

 

MOTOR VEHICLE INDUSTRY LICENSING BOARD

Respondents:      Federico Sobrino and Concordia Motors, LLC

Case Number:     MVI 2013-75-L

Sanction:             $500 fine                                                                                                                          

Effective Date:     12-19-17

Respondents allegedly listed five vehicles for sale on Craigslist belonging to Respondent Concordia under the “cars and trucks by owner” category instead of under the “cars and truck dealership” category, in possible violation of HRS §§ 437-4(e), 437-28(a)(2), 437-28(a)(13) and 437-4(d).  (Board approved Settlement Agreement.)

 

BOARD OF NURSING

Respondent:        Lisa J. Topp (Hawaii)

Case Number:     RNS 2015-76-L

Sanction:             $750 fine                                                                                                                          

Effective Date:     12-7-17

On or about November 26, 2013, Respondent was allegedly convicted of driving under the influence of an intoxicant.  Despite the conviction, Respondent answered “no” to question 3 on her renewal application dated November 3, 2015, which asked, “In the past 2 years, have you been convicted of a crime which has not been annulled or expunged?”, in possible violation of HRS § 457-12(a)(11) and HAR § 16-89-60(1).  (Board approved Settlement Agreement.)

 

SOCIAL WORKER LICENSING PROGRAM

Respondent:        Barbara Ann Y.U. Lee

Case Number:     RSW 2017-17-L

Sanction:             $100 fine                                                                                                                          

Effective Date:     12-27-17

Respondent failed to complete three required continuing education credit hours in ethics during the July 1, 2013 to June 30, 2016 licensing period in violation of HRS §§ 467E-11 and 467E-12(a)(1).  (Program approved Settlement Agreement.)

 

Respondent:        Fay H. Sugahara

Case Number:     RSW 2017-19-L

Sanction:             Voluntary surrender of license                                                                                         

Effective Date:     12-27-17

Respondent allegedly failed to complete required continuing education credit hours during the 2014-2016 licensing period, in potential violation of HRS § 467E-12(a)(1).  (Program approved Settlement Agreement.)
