DCCA DISCIPLINARY ACTIONS
(Through November 2018)
HONOLULU – The state Department of Commerce and Consumer Affairs (DCCA) and the state Boards and Commissions released a summary of disciplinary actions through the month of November 2018 taken on individuals and entities with professional and vocational licenses in Hawaii. These disciplinary actions include dispositions based upon either the results of contested case hearings or settlement agreements submitted by the parties. Respondents enter into settlement agreements as a compromise of claims and to conserve on the expenses of proceeding with an administrative hearing.
The DCCA and the Boards and Commissions are responsible for ensuring those with professional and vocational licenses are performing up to the standards prescribed by state law.
BOARD OF NURSING
Respondent: Dianne C. Williams fka Dianne C. McLamore
Case Numbers: RNS 2016-19-L
Sanction: License revocation and $1,000 fine
Effective Date: 11-1-18
Respondent was the subject of disciplinary actions taken by five (5) states based on failure to file or pay state taxes, of which Respondent failed to report four (4) of those disciplinary actions to the Board in a timely manner, in violation of HRS §§ 436B-19(8) and (12) and 457-12(a)(6), (8) and (10). (Board’s Final Order after contested case hearing.)
Respondent: Jennifer L. Putt fka Jennifer L. Weigert, R.N.
Case Numbers: RNS 2017-57-L
Sanction: Voluntary surrender of license
Effective Date: 11-1-18
Respondent was allegedly the subject of disciplinary action in Florida based on allegations related to Respondent’s fitness to practice nursing, in possible violation of HRS § 457-12(a)(8). (Board approved Settlement Agreement.)
BOARD OF PHYSICAL THERAPY
Respondent: Haley A. Waud
Case Numbers: PTS 2017-6-L
Sanction: Complete six (6) continuing competency units and $100 fine
Effective Date: 11-13-18
Respondent failed to complete six (6) continuing competency units, in violation of HRS §§ 461J-10.1 and 461J-12(a)(11. (Board approved Settlement Agreement.)
BOARD OF PROFESSIONAL ENGINEERS, ARCHITECTS, SURVEYORS AND LANDSCAPE ARCHITECTS
Respondent: Dilip M. Khatri
Case Number: ENG 2017-10-L
Sanction: $1,000 fine
Effective Date: 11-8-18
Respondent was allegedly disciplined by the State of California, based on allegations related to negligence and misrepresentation issues, and failed to report the disciplinary action to the Hawaii Board within 30 days as required by Hawaii law, in possible violation of HRS §§ 436B-19(13) and 436B-19(15). (Board approved Settlement Agreement.)
CONTRACTORS LICENSING BOARD
Respondent: Chelsie L. Haunga dba Division I Contracting
Case Number: CLB 2014-277-L
Sanction: Voluntary revocation of license
Effective Date: 11-16-18
RICO alleges that: Respondent failed to perform a renovation project as required in the contract, specifically, Respondent failed to make the bathroom ADA compliant; Respondent’s work did not conform to industry standards for the work completed; Respondent performed work that installed, repaired, or altered a complete plumbing system, and in doing so, performed plumbing activity without a C-37 (plumbing) specialty license; and Respondent failed to return to complete, or otherwise address, the punch list, which included items contracted for but left unfinished, in possible violation of HRS §§ 444-17(12) and (13) and HAR §§ 16-77-33(a) and 16-77-97. Sanction: $500 fine
Effective Date: 11-16-18
RICO alleges that Respondent failed to report an outstanding judgment on his 2014 renewal application and failed to report a pending RICO investigation on his 2016 and 2018 renewal applications, in possible violation of HRS § 444-17. (Board approved Settlement Agreement.)

Case Number: CLB 2018-132-L
Sanction: $250 fine
Effective Date: 11-16-18
RICO alleges that Respondent entered into a contract to install a nurse call and fall alarm system and did not have a RME with a C15 or C15B classification, in possible violation of HAR § 16-77-33. (Board approved Settlement Agreement.)
BOARD OF BARBERING AND COSMETOLOGY
Respondent: Margaret E. Patterson (Hawaii)
Case Number: BAR 2018-134-L
Sanction: $500 fine
Effective Date: 11-17-18
RICO alleges that on or about December 30, 2017, Respondent indicated “no” to question number 3 on her renewal application “In the past 2 years have you been convicted of a crime which has not been annulled or expunged?” for her beauty operator’s license despite her Operating a Vehicle Under the Influence of an Intoxicant conviction on December 21, 2016, in possible violation of HRS §§ 439-19(a)(1) and (9). (Board approved Settlement Agreement.)
BOARD OF PHARMACY
Respondent: Mark A. Flanary
Case Number: PHA 2018-21-L
Sanction: $500 fine
Effective Date: 11-15-18
RICO alleges that Respondent self-reported being disciplined by the Kentucky Board of Pharmacy for failing to timely complete continuing education requirements, in possible violation of HRS § 436B-19(13). (Board approved Settlement Agreement.)
REAL ESTATE COMMISSION
Respondent: Harry S. Newhart
Case Number: REC 2018-115-L
Sanction: $500 fine
Effective Date: 11-21-18
RICO alleges that in or around March 2018, Respondent was convicted in Hawaii of the crime of Operating a Vehicle Under the Influence of an Intoxicant, in possible violation of HRS §§ 436B-19(12), (14) and (17). (Commission approved Settlement Agreement.)
Respondents: Rachel K.H. Le and Real Estate Emporium, LLC
Case Number: REC 2017-412-L
Sanction: $1,000 fine
Effective Date: 11-21-18
RICO alleges that Respondents failed to timely return a security deposit to tenants after the tenants vacated a property managed by Respondents, in possible violation of HRS §§ 467-14(7) and (20). (Commission approved Settlement Agreement.)
Respondent: Amanda L. Donaldson
Case Number: REC 2016-263-L
Sanction: License revocation
Effective Date: 11-21-18
Respondent failed to pick up the keys to the properties and did not respond to Complainant’s emails and telephone calls regarding Respondent’s management of the properties; Respondent failed to provide Complainant with an accounting of the monies received on account of the 5 properties; and Respondent failed, refused or neglected to respond to Petitioner’s investigator’s request for records, in violation of HRS §§ 467-14(7) and (20), HRS § 436B-19(7) and HAR §§ 16-99-3(b) and 16-99-4(b). SOCIAL WORKER LICENSING PROGRAM
Respondent: Joanne Hansel King aka Jo Anne Hansel Gardner
Case Number: RSW 2017-14-L
Sanction: Voluntary Surrender of License
Effective Date: 11-21-18
Respondent allegedly failed to complete fifteen (15) continuing education credit hours required to be completed during the licensing period beginning July 1, 2013 and ending June 30, 2016, in possible violation of HRS §§ 467E-11 and 467E-12(a)(1). (Director approved Settlement Agreement.)
COLLECTION AGENCY PROGRAM
Respondent: LTD Financial Services, L.P.
Case Number: COL 2018-143-L
Sanction: $500 fine
Effective Date: 11-21-18
Respondent was allegedly disciplined by the State of Wisconsin, based on allegations Respondent failed to timely submit an annual report, and failed to report the disciplinary action to the Hawaii Program within 30 days as required by Hawaii law, in possible violation of HRS § 436B-19(15). (Director approved Settlement Agreement.)
Respondent: Investment Retrievers, Inc.
Case Number: COL 2018-20-L
Sanction: $500 fine
Effective Date: 11-26-18
Respondent was allegedly disciplined by the State of Idaho, based on allegations Respondent engaged in business in Idaho prior to being licensed, and failed to report the disciplinary action to the Hawaii Program within 30 days as required by Hawaii law, in possible violation of HRS §§ 436B-19(13) and 443B-3.5(h). (Director approved Settlement Agreement.)
