Office of Administrative Hearings (OAH)
OAH conducts administrative hearings and issues recommended orders and decisions for the Department of Commerce and Consumer Affairs and other agencies. We ensure due process for all contested cases in accordance with (HRS) chapters 91 and 92.
Who We Are
About Us
The kinds of cases heard by the Office of Administrative Hearings include:
- Disciplinary proceedings against professional and vocational licensees.
- Hearings to contest the denial of an application for licensure or registration, or the denial of an application for renewal or restoration.
- Hearings to contest the issuance of citations for engaging in activities for which a professional or vocational license is required.
- Disputes involving the denial or withholding of no-fault or personal injury protection benefits.
- Disputes involving the legal ownership of trade names, trade marks, partnership names, and corporate names.
- Hearings to contest the issuance of cease and desist orders issued by the boards, commissions, programs, and divisions of the Department of Commerce and Consumer Affairs.
Other Areas of Jurisdiction
- Disputes arising from the State’s procurement laws (HRS chapter 103D and its implementing rules)
- Contested case hearings involving the Employees’ Retirement System of the State of Hawai’i.
- Disputes among manufacturers, distributors, or dealers of motor vehicles covered by part II of HRS chapter 437.
- Tort claims against design professionals under HRS chapter 672B. These cases are heard by the Design Claim Conciliation Panel.
- Medical inquiries under HRS chapter 671. These cases are heard by the Medical Inquiry and Conciliation Panel.
Administrator’s Message
Since its creation in 1978, the Office of Administrative Hearings has provided contested case hearings for all administrative matters within the jurisdiction of the Department of Commerce and Consumer Affairs.
In fulfilling our responsibilities to provide fair and impartial contested case hearings in a professional and timely manner, we have adopted the same professional and ethical standards that are followed by the judiciary, and are continuously updating our professional training, as well as our procedures.
The Office of Administrative Hearings has embarked upon a very substantial effort to place all of the decisions of the Office of Administrative Hearings on-line, as well as ultimately increasing the opportunities for the electronic filing and processing of documents.
As we continue to improve the contested case hearings process, our efforts will always be guided by our primary responsibilities of fairness and professionalism.
