Cable Franchises and Renewals
The Department of Commerce and Consumer Affairs, Cable Television Division (CATV) is responsible for granting new cable television franchises and renewing existing cable television franchises in the State of Hawaii.
The new cable television franchise application process is for cable operators who apply to provide services in an area where they currently do not operate. New cable television franchise applications are reviewed, investigated, and analyzed to ensure that applicants are financially, legally, operationally, and technically qualified to operate a cable television system. Furthermore, applicants must understand the privilege of operating a cable television franchise, and the importance of abiding and adhering to the agreed upon terms and conditions. New cable television franchise application proceedings are guided by Hawaii Revised Statutes (HRS) Chapter 440G, and Hawaii Administrative Rules (HAR) Chapter 16-133.
The cable television franchise renewal process is for cable operators who have been granted a cable television franchise and are near the end of their cable television franchise term Cable television franchise renewal applications are reviewed, investigated, and analyzed to ensure that applicants are financially, legally, operationally, and technically qualified to maintain a cable television franchise. Furthermore, CATV verifies that applicants have complied with material terms of the existing cable franchise and applicable law. Applicants must reaffirm their understanding of the privilege of operating a cable television franchise, and the importance of abiding and adhering to the agreed upon terms and conditions of the renewal. Cable television franchise renewal application proceedings are guided by HRS § 440G-10 and HAR Chapter 16-133.
