The Affordable Care Act (“ACA”) requires disclosure of small group and individual (non-group) rates if the increase in rates is over or equal to 10 percent. Healthcare.gov provides access to the rate review justifications for insurers through this website. The information provided in the small group premium comparison sheet is made available through Hawaii Revised Statutes §431:14G-109.5, which was proposed by the Insurance Division in 2014. This law creates openness and rate transparency by requiring Hawaii’s health insurers to allow their small group ACA rates to be published.

The ACA Small Business Health Options Program (“SHOP”) Marketplace is designed to facilitate the sale of health insurance to small businesses through the Department of Labor & Industrial Relations. Currently SHOP is open to employers, including non-profit organizations, with 50 or fewer full-time equivalent employees. In SHOP direct enrollment a business owner, working alone or through their agent or broker, can purchase a SHOP qualified health plan directly from a health insurer. A business owner may be eligible for the Small Business Health Care Tax Credit under some circumstances.
